These Terms & Conditions (“Terms”) apply to Cherry, operated by Cherry PI Pty Ltd (ACN 698 387 432) (“Cherry”, “we”, “our”, or “us”).

By accessing this website, submitting information through our forms, or participating in any Cherry pilot programme or service, you agree to these Terms

These Terms are governed by the laws of New South Wales, Australia. Users agree to submit to the non-exclusive jurisdiction of the courts of New South Wales.

Personal information submitted through pilot applications, contact forms, or other website interactions is handled in accordance with Cherry's Privacy Policy.

1. About Cherry

Cherry is a developing project intelligence platform designed to support PMOs, delivery teams, project managers and enterprise transformation programmes through improved project visibility, reporting and operational insights.

Cherry is currently in active pilot development and testing.

2. Pilot Programme & Pre-Release Services

Cherry products, concepts, demonstrations, mock-ups, screenshots, workflows and features may:
• change over time
• be incomplete
• contain errors or limitations
• differ from future commercial releases

Participation in any pilot programme does not guarantee:
• ongoing access
• feature availability
• future pricing
• product roadmap commitments
• commercial release timelines

Cherry reserves the right to modify, pause or discontinue pilot programmes with reasonable notice where practicable.

Where a participant enters into a separate Pilot Participation Agreement with Cherry, that agreement takes precedence over these Website Terms to the extent of any inconsistency.

3. No Professional Advice

Information, insights, visualisations or outputs generated by Cherry are provided for general informational purposes only.

Cherry does not provide:
• legal advice
• financial advice
• engineering certification
• project assurance
• professional consulting services

Users remain solely responsible for project decisions, governance, delivery outcomes and stakeholder communications.

4. Intellectual Property

All content, branding, concepts, designs, workflows, graphics, software, documentation and materials associated with Cherry remain the intellectual property of Cherry PI Pty Ltd unless otherwise stated.

You may not:
• copy
• reproduce
• distribute
• reverse engineer
• commercially exploit
• replicate platform concepts or materials
without prior written permission.

Participation in pilot activities does not transfer ownership of any Cherry intellectual property.

5. Confidentiality

Cherry respects confidential business information shared during pilot discussions or demonstrations.

Pilot participants should treat non-public Cherry materials, product concepts, demonstrations, screenshots, pricing information and roadmap information as confidential unless otherwise agreed in writing.

6. Acceptable Use

You agree not to:
• misuse the website or services
• attempt unauthorised access
• upload malicious content
• interfere with platform functionality
• use Cherry for unlawful purposes

Cherry reserves the right to restrict or remove access where misuse is identified.

7. Limitation of Liability

To the maximum extent permitted by law, Cherry PI Pty Ltd is not liable for:
• indirect or consequential loss
• loss of profits
• business interruption
• project delays
• reliance on pilot outputs or prototype functionality
• data inaccuracies or omissions

All services and pilot access are provided “as is” without warranties of any kind.

8. Future Features & Roadmap

Any references to future integrations, capabilities, workflows or roadmap items are indicative only and subject to change.

Nothing on this website constitutes a contractual commitment to deliver future functionality.

9. Third-Party Services

Cherry may utilise third-party providers including hosting, analytics, communication or software platforms.

We are not responsible for outages, failures or limitations caused by third-party services.

10. Termination

Cherry reserves the right to suspend or terminate access to pilot programmes, communications or services at any time without notice.

11. Changes to These Terms

We may update these Terms from time to time.

Updated versions will be published on this page with a revised effective date.
